Terms & Conditions

  1. FLASHNET’s Acceptable Use Policy (AUP) is designed to prohibit illegal, unlawful, or otherwise unacceptable usage, and to ensure full compliance with the laws of the United Republic of Tanzania. This Policy is governed by the laws of the United Republic of Tanzania and, unless otherwise specified in the Master Service Agreement (MSA), establishes the exclusive forum for resolving any disputes arising hereunder.

2. Definitions

  •  “AUP”: Acceptable Use Policy.
  • “User”: Any person or entity that directly or indirectly uses FLASHNET Services. 
  • “Client”: A party that has a contractual relationship with FLASHNET for the provision of Services
  • “Services”: The internet, network, and related offerings provided by FLASHNET to its users and clients, including but not limited to email, web hosting, FTP, VPN, and connectivity.
  • “Network”: The telecommunications and data infrastructure owned, operated, or controlled by FLASHNET, including IP addresses, systems, and equipment used to deliver Services.
  • “Applicable Law”: The laws, regulations, and statutes of the United Republic of Tanzania, as well as any local, national, or international laws enforced by government or authorities that are relevant to the use of FLASHNET Services.

3. This AUP is also intended in ensuring our users are guided correctly and are able to use and enjoy our services.

4. All directly and indirectly users of FLASHNET Services must comply with this AUP and this AUP form’s part and parcel of contract between FLASHNET and its client.

5. FLASHNET advises against, prohibits where applicable, does not support or promote using our services to:

  • Resell our services without written approval or a legal agreement 
  • Provide or intend to threaten, harass, via any material, or encourage any bodily harm or destruction of property
  • Download, upload, or share any material by any means that may intentionally or unintentionally violate any regulations and/or law (local, national or international) enforced by the government or the authorities
  • Be involved in forgery, impersonation, fraudulent activity including, but not limited to, financial scam, directly or indirectly
  • Cause or intend harm to anyone including minors
  • Cause any kind of interference on the network, harm users, our services and/or the network including Denial of Service (DoS) attacks
  • Mislead or deceive by modifying any content
  • Infringe, distribute, use or share content/software/material that has been copyrighted, registered and/or trademarked or be involved in plagiarism
  • Share or send any unsolicited commercial, spam, bulk email or be involved in any sort of activities that can be categorized as unsolicited commercial email or transmission of information
  • Access or collect someone else’s personal data, services, accounts, emails, connection, and/or attempt to bypass or break through security measures implemented, such as passwords and/or encryption 

6. FLASHNET does not generally or actively monitor the usage or control any publication, editorial content over electronic mail, social websites, blogs, groups, website hosted or not hosted by FLASHNET and/or through any medium used through our services. However, we reserve the right to monitor, control, save, keep, or remove any materials that, in our discretion, may be illegal, may subject us to liability, or which may violate this AUP or SLA or MSA, and such monitoring will be conducted only to the extent permitted by law and for legitimate purposes such as security, regulatory compliance, and network integrity.

7. FLASHNET shall cooperate with legal authorities and/or third parties in the investigation of any suspected or alleged crime or civil wrong. Any violation in accordance with the law, international standards, piracy, and or clauses of this AUP may result in, but is not limited to, suspension or termination of services or accounts.

8. FLASHNET may suspend, terminate, or disconnect service to any customer for legally or factually valid reasons, including but not limited to misconduct, violation of Tanzanian law, breach of the AUP (available at www.flashnet.co.tz) or SLA, or failure to pay for services. Immediate suspension may occur without notice when required to safeguard the network, comply with the law, or avert harm; however, FLASHNET will notify the customer when reasonably practicable.

9. FLASHNET will implement all possible measures to maintain a high standard of service and availability. However, FLASHNET cannot be held responsible for interruption in services due to power failures, equipment malfunctions, beyond FLASHNET’s control, or acts of natural calamity.

10. FLASHNET cannot be held responsible for the user’s Local Area Network, PCs and/or devices that FLASHNET does not have control over.

11. FLASHNET reserves the right to block any harmful or suspicious activity and/or revoke, suspend, or block any IP address provided or used.

12. FLASHNET recommends users to implement and use all security measures as FLASHNET cannot be responsible for the users’ privacy and security of personal data or accounts.

13. FLASHNET cannot be held responsible for any data, information or material any user or non-user may send or receive directly, indirectly, intentionally, and unintentionally through our services as well as any third party.

14. FLASHNET reserves the right to establish best practices in the interest of the users, security, limitations, filtering of content, standards including, but not limited to quotas, data transfer limits, number of emails sent per hour/day.

15. FLASHNET cannot be held responsible for backup of any data stored, transferred or accessed via our Services, including but not limited to domains, websites, databases, FTP, DNS records, emails.

16. It is the users’ responsibility to take timely backups and store them for security purposes and restoration during emergency or system failures.

17. FLASHNET Reserves the right to control or block known malware, viruses, infections or harmful traffic.

18. All users must notify FLASHNET of the services required and hosted on their private network. This includes, but is not limited to, mail, Web, FTP, VPN, port-forwarding requirements.

19. The users will be responsible for configuration and maintenance of services and servers hosted within their network, including but not limited to blacklisting and deleting of Public IP Addresses across the internet.

20. The users must make sure that the services hosted on their network are free from spamming, viruses and/or infections that can spread in any way.

21. FLASHNET reserves the right to modify, without notification, the Standard Service Level Agreements and AUP which is made available online on FLASHNET’s website (www.flashnet.co.tz) for clients at any time.

22. This AUP is supplemented by FLASHNET’s Privacy Policy, available on FLASHNET’s website, which governs the processing of personal data. FLASHNET complies with applicable Tanzanian data protection laws, including the Personal Data Protection Act. By using our Services, Users and Clients acknowledge that they have read and agree to the Privacy Policy and consent to the processing of their personal data as described therein and are responsible for ensuring their own compliance with data protection laws.
